1. Parties and acceptance
These Terms of Service govern the relationship between COLITU LIMITED ("Colitu", "we"), which operates the Colitu VPN service (the "Service"), and the person using it ("you"). By creating an account, installing the apps or using the Service you accept these terms together with the User Agreement, the Privacy Policy and the Acceptable Use Policy.
2. The Service
Colitu is a virtual private network (VPN) service that sends your internet traffic through an encrypted tunnel to Colitu servers. It comes with apps for Android (including Android TV), Windows, Linux (beta) and iOS, a web account portal, support channels and a help centre. By design the apps send some traffic outside the VPN (for example some regional sites on a built-in list, so that services which refuse foreign IP addresses keep working; this does not apply when you are connected to a server in that region); details are in the Privacy Policy. Server locations, protocols and service availability (e.g. AI and streaming platforms) may change over time; the availability of third-party services is not guaranteed.
3. Account
- A valid e-mail address is required and verification may be requested.
- You are responsible for accurate account details and for keeping your password secret.
- An account belongs to one person. You may not sell, transfer or rent your account.
- You may not use the Service if you are under 16.
4. Free plan
Registered accounts may use the free plan: 1 GB of traffic a month on 1 device. The allowance renews at the start of each calendar month (UTC); unused traffic does not carry over. When the allowance is used up, access pauses until the end of the month unless a paid plan or a premium trial is active. The free plan is not given to several accounts of the same person, the same mailbox (including alternative spellings), the same device or the same network. Attempts to abuse it may end the free plan and restrict the account. We may change or withdraw the free plan with prior notice. 24-hour trials granted earlier stay valid until they end.
5. Subscription and payment
- Paid plans are offered as Personal, Plus and Family. Each plan has a fixed number of devices and can be paid monthly or yearly. Current prices and device counts are shown on the Pricing page and before payment. No card is needed for the free plan or a premium trial.
- Existing paid subscriptions keep the terms under which they were bought and can be managed from the subscription page of your account (including turning off automatic renewal).
- Prices are shown in pounds sterling (GBP); Russian-language pages show roubles, and some languages also show an approximate local amount. Payments are charged in Russian roubles (RUB); the total, including any payment method fees, is shown before you pay. Payments are processed by a third-party payment provider; Colitu does not receive your card details. Access starts once the payment is confirmed.
- Payments are one-time payments for the period you choose and do not renew unless you turn on automatic renewal from the subscription page of your account. You can turn it off there at any time; access continues until the end of the period already paid.
- Promo codes and free trials do not renew and never lead to a charge.
- Each plan has a fixed number of devices. For more devices you can buy a bigger plan; the amount is shown before payment.
- We may change prices for future periods. The price of a period already paid does not change.
6. Device slots
No more devices than your plan allows can be connected to your account at the same time. You can manage your devices on your account page. Attempts to exceed the device limit are recorded.
7. Refunds
We consider refund requests where we could not provide the Service because of a technical fault on our side or where applicable consumer law requires it. Requests must be sent through support within 14 days of payment. Accounts terminated for breaching the terms are not refunded. This section does not limit mandatory rights you have under applicable law.
8. Acceptable use
You may not use the Service for unlawful purposes or in a way that harms others. Detailed rules are in the Acceptable Use Policy. If the rules are broken we may suspend access or close the account.
9. Availability
We make reasonable efforts to provide the Service continuously; interruptions may nevertheless occur because of maintenance, network restrictions, third-party infrastructure failures or force majeure. We announce planned maintenance in advance where possible.
10. Intellectual property and open-source licence
- The Colitu apps for Windows, Android, iOS and Linux are free software released under the GNU General Public License version 3 (GPL-3.0); their source code is at github.com/colitu (the iOS app at github.com/colitu/ios). Nothing in these terms limits the rights that licence gives you, including the rights to study, modify and redistribute that software under its conditions.
- The server software and the website are proprietary; copying, redistributing or reverse engineering them is prohibited except where the law allows it.
- The Colitu name and logo are not licensed under the GPL. Modified versions of the open-source apps must not use the Colitu name or logo or present themselves as official Colitu software.
- Other content on the website belongs to Colitu or its licensors.
11. Limitation of liability
The Service is provided "as is". To the extent permitted by applicable law we are not liable for indirect damages, lost profits, data loss or the unavailability of third-party services. Our total liability is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. This limitation does not apply to intent or gross negligence or where the law does not allow it.
12. Termination
You can close your account at any time. We may suspend access or close your account for serious or repeated breaches of these terms, abuse, or where the law requires it.
13. Changes
We may update these terms. We announce significant changes on the website or by e-mail at least 14 days before they take effect. Continuing to use the Service after a change means you accept the updated terms.
14. Operator, governing law and contact
The Service is provided by COLITU LIMITED, a company registered in England and Wales; registered office: 128 City Road, London, United Kingdom, EC1V 2NX; company number 17520342. Disputes are handled under the law that applies to them, and mandatory rights granted to you as a consumer by your country of residence remain unaffected. We try to resolve complaints directly first.
